Actions OR Intentions?

How would describe someone? By the actions or intentions? I think I would look at them by there intentions not there actions. This is because someone could have the means to do something good but they don’t. Say that someone was going to robed a store, but once they broke in the alarms went off and cops got him. He didn’t steal anything but he was going to. Would you put  him in jail or not? What if you hear that he was just trying to get some medicine for his child that was very ill? Would you still send him to jail even if his child didn’t get this medicine he would die? If you wouldn’t then that would be looking at his intentions. There is another example on Diana’s blog. She works at a school and they didn’t get their newspaper because of something that was written in the paper would have been inappropriate. And the publisher said he would call them but he never did. What would you do?
